Perini Navi S.p.A. (hereinafter “Perini Navi” or “Data Controller”) is constantly committed to protecting its users’ data and this document provides information on the processing of personal data collected through the application for mobile devices (hereinafter “App” – downloadable from the respective suppliers’ store) operating system) or during the use of your personal account created following registration.

This notice is provided only for the use of the functions of the App or of your personal account and not for the platforms and devices on which it operates or interacts.

  1. WHAT INFORMATION DO WE COLLECT?

    1. Data collected for account registration

To use the service it is necessary to register an account. The following personal data is required for registration:

  • Name and surname;
  • Company name;
  • Business e-mail address;
  • Business mobile phone number;
  • Company logo.

Registration is entirely optional and is subject to approval by the administrative offices of Perini Navi.

Following the approval, an e-mail with login credentials will be sent.

    1. Data collected during the interaction with the App or use of the personal account

During the interaction with the App or the use of one’s credentials, data relating to the connections are recorded by the information systems as well as the data relating to the use of the services, such as for example the interactions of users, even unregistered, with the services provided in order to constantly check its operation and proceed with any necessary updates, also based on the statistics generated through use.

    1. Data collected for the creation of Brochures

The use of the specific service allows the creation of personalized and named Brochures. The inclusion by the user of any personal data of third parties assumes the lawfulness of the processing by the users. The document generated during the use of the service is stored by Perini Navi to allow the user to restore the data.

    1. Data collected by third parties regardless of the use of the application

During their normal operation, IT systems and software procedures for downloading and operating the App (such as e. g. Apple Store, Google Play) collect some data referable to the User whose transmission is implicit in the use of Internet communication protocols, smartphones and devices used. This category of data includes e.g. geographical location, IP addresses, User’s contacts, e-mail address, credit card details.

  1. WHY IS PERSONAL DATA COLLECTED?

We use your personal data as set forth below:

  • User identification. Services are available only to registered professionals, so the data are necessary to verify the user’s accreditation.
  • Provide and improve services and products. The data collected are processed in order to provide the services offered by Perini Navi, as well as to improve the services and products offered by Perini Navi.
  • Communicate with the user. Perini Navi processes the data to communicate with the user through different channels, depending on the data provided (e.g. e-mail and telephone).
  • Defence of legal claims. The data collected can also be processed for the exercise or defence of legal claims, or transmitted at the request of the competent authorities.
  • Marketing purposes. Perini Navi will use your contact details for sending communications for marketing purposes also related to the use of the services offered by the App or the information displayed during the use of the App.

  1. WHAT ARE THE LEGAL BASIS OF THE PROCESSINGS?

For the creation of the account, the use of the services offered and for the communications by Perini Navi, the legal basis is the execution of a contract of which data subject is a party or the execution of pre-contractual measures adopted at his request.

The processing of user interaction data is carried out based on Perini Navi’s legitimate interest in the constant improvement of its services and products.

The data may be used for marketing purposes and in particular for sending promotional communications related to the use of the services only with your explicit consent.

  1. NECESSARY PROCESSINGS AND OPTIONAL PROCESSINGS

All data (marked with the symbol [*]) are necessary and failure to provide them does not allow the provision of the service, such as user registration.

  1. DO WE DISCLOSE YOUR PERSONAL DATA?

Your personal data may be shared, when strictly necessary for the purposes indicated, with:

  1. third parties to whom the Data Controller has entrusted the specific processing of personal data necessary to carry out activities strictly related to the provision of the Services;
  2. third parties that provide instrumental services to the Company, which typically act as processors, such as operators of communication services, e-mail, technical services for hosting management or other IT service providers;
  3. subjects, entities or authorities to which it is mandatory to communicate personal data pursuant to legal provisions or orders of the authorities.

These subjects will only receive the data necessary for the relative functions and will commit to use them only for the purposes indicated above and to treat them in compliance data protection regulation. The updated list of data processors is available by sending a written request to Perini Navi.

  1. DO WE TRANSFER YOUR PERSONAL DATA TO THIRD COUNTRIES?

There are no transfers of personal data outside the European Union. If the transfer is necessary it will be carried out exclusively in Third Countries considered safe based on the requirements provided for in Chapter V of the GDPR.

  1. HOW DO WE PROTECT YOUR PERSONAL DATA?

Perini Navi commits to protect the security of the user’s personal data and complies with the provisions on security provided by the regulations in order to avoid loss of data, illegitimate or illegal use of data and unauthorized access. In addition, Perini Navi shall use only processors providing sufficient guarantees to implement appropriate technical and organisational measures in such a manner that processing will meet the requirements of this Regulation and ensure the protection of the rights of the data subject.

It is important that the user takes appropriate measures to prevent unauthorized access to their login credentials and to their devices and applications.

  1. HOW LONG IS YOUR PERSONAL DATA RETAINED?

IT systems and software used by the Data Controller are configured so as to minimize the use of personal and identification data; the data will be stored for the period of time strictly necessary for the purposes for which the personal data are processed and, in any case, the criteria used to determine the retention period is based on compliance with the terms allowed by the applicable laws and the principles of minimization of processing, limitation of conservation and rational management of archives.

The identification data will be stored according to the legal terms related to the conservation of the contractual documentation. The data relating to statistics will be stored for a maximum of 12 months.

  1. ARE CHILDREN ALLOWED TO USE THE SERVICES?

The services are aimed at adults, therefore, no person under the age of 18 can send information without the prior consent of their parents or guardian.

  1. WHAT ARE YOUR RIGHTS REGARDING YOUR PERSONAL DATA?

You can exercise the rights established by the CHAPTER III of the Regulation EU 2016/679 at any time. In particular, you have the right to obtain the access to your personal data, to rectify or to erase them, to integrate the incomplete data, to restrict the processing; to receive the data in a commonly used and machine-readable format; to withdraw the consent and to object all or in part the use of the data, as well as to exercise the other rights provided by the applicable discipline.

Pursuant to art. 77 of the Regulation, you have the right to lodge a complaint with a Supervisory Authority if you consider that data processing infringes the Regulation.
